It is our understanding that while the CPA allows for it, having a Town entity hold a preservation/conservation restriction on the Town or another Town entity essentially invalidates the restriction. We are curious as to who other communities are getting to hold their preservation/conservation restrictions. The real challenge we have run into is with regard to a recreation restriction. Does any one else have a recreation project owned by the Town and who holds your restriction?
