In Dracut, we just went through an open space purchase. We had to convey a Conservation Restriction to a qualified 3rd party that is not directly connected to municipal gobernment. If you don't have a local land trust then this can be troublesome. Once we had a willing party to hold the C.R. then we obtained a model C.R. from Joel Lerner at the Division of Conservation Services. After many $$$ hours of legal counsel's time it was bounced back to us by Mr. Lerner with further corrections that he made necessary. On our second submittal to Mr. Lerner, he forwarded the C.R. to the Secretary of the E.O.E.A. With the legal work, signatures, notorizations, etc. I would plan on at least four months to complete the process the first time. We found the process very demanding, expensive, and time consuming. Last week, I gave it back to Town Counsel to record. Next week I plan on calling to make sure its done and to collect the recording information because now Mr. Lerner has requested that a GIS Data Entry form and an accurate USGS map be submitted to confirm the boundaries of the C.R. Luckily, we had done much of the ground work for this as part of a successful Self-Help Grant. C.R. REQUIRED!!! Good Luck.
